These Terms of Service ("Terms") govern your use of the ScopeOut web application at scopeoutfl.com (the "Service"), operated by Automated Insights LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

ScopeOut is a Florida real estate intelligence platform that provides neighborhood data including flood zones, crime heatmaps, safety scores, amenity access, demographic information, and investment analytics. The Service aggregates data from public government sources and third-party APIs and presents it through an interactive map interface.

2. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Data displayed on ScopeOut is sourced from government agencies (FEMA, Census Bureau, USGS, HUD) and other public sources. While we strive to present accurate and current information, we do not guarantee the accuracy, completeness, or timeliness of any data. Government data sources may contain errors, may be outdated, or may not reflect the most current conditions.

You should always verify critical data — including flood zone designations, crime statistics, and property details — with official sources before making financial, legal, or personal decisions. ScopeOut is an informational tool, not a substitute for professional advice.

3. Limitation of Liability

To the maximum extent permitted by law, Automated Insights LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to losses resulting from reliance on data presented by ScopeOut, property purchasing decisions, investment outcomes, or insurance determinations.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50, whichever is greater.

4. Free Tier Usage

The free tier of ScopeOut allows up to 10 address lookups per day. This limit resets daily. We reserve the right to adjust free tier limits at any time. Automated or programmatic access to the Service (scraping, bots, or bulk queries) is prohibited without prior written permission.

5. Pro Subscription

ScopeOut Pro is available as a monthly subscription at $9.99 per month. By subscribing, you agree to the following:

• Your subscription renews automatically each month until cancelled.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• No refunds are issued for partial months. If you cancel mid-cycle, you retain Pro access until the end of that billing period.
• We reserve the right to change subscription pricing with 30 days' notice to active subscribers.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Scrape, crawl, or programmatically access the Service without authorization
• Interfere with or disrupt the Service's infrastructure
• Resell, redistribute, or commercially exploit data obtained from the Service without written permission
• Misrepresent ScopeOut data as your own research or analysis in commercial publications without attribution

7. Intellectual Property

The ScopeOut name, logo, user interface design, source code, and original content are the intellectual property of Automated Insights LLC. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent. Data sourced from government agencies remains in the public domain as provided by those agencies.

8. Third-Party Services

ScopeOut relies on third-party data providers and APIs. We are not responsible for the availability, accuracy, or terms of service of these third-party providers. Changes or outages in third-party services may affect the functionality of ScopeOut.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include violation of these Terms, abuse of the Service, or fraudulent activity.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Florida.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
